FITNEX ("FITNEX", "we", "us" or "our") operates the website fitnexusa.com and related services (the "Platform"). The Platform helps people ("Clients") find, book and pay for sessions with independent fitness and wellness professionals ("Trainers" or "Coaches"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.
By using the Platform, you agree to the practices described in this policy. If you do not agree, please do not use the Platform.
1. Information We Collect
Information you give us
- Account information: your name, email address, phone number, password and profile photo when you register or update your profile.
- Trainer profile information: for Trainers, details such as services offered, training types, certifications, experience, pricing, location, availability, biography, photos and social media links.
- Finder and booking information: answers you give when searching for a professional (such as the service you need, in-person or online preference, location and fitness goals), and booking details such as date, time, time zone and any notes you add.
- Payment information: payments are processed by our payment provider, Stripe. We do not store your full card number. We receive limited details from Stripe, such as payment status, amount and a transaction reference.
- Reviews and messages: reviews and ratings you post, and messages you send us through contact forms or email.
Information collected automatically
- Device and usage data: IP address, browser type, device information, pages viewed, and dates and times of visits.
- Cookies: we use cookies and similar technologies to keep you signed in, remember your preferences, protect against fraud and understand how the Platform is used. You can control cookies through your browser settings, but some features may not work without them.
Information from third parties
- Sign in with Google: if you choose to sign in with Google, we receive your name, email address and profile picture from Google.
- Google Calendar (Trainers): if a Trainer chooses to connect their Google Calendar, we receive permission to create, update and delete calendar events for FITNEX bookings (see Section 4).
2. How We Use Your Information
- To create and manage your account and Trainer profile.
- To match Clients with suitable Trainers based on the preferences and goals they provide.
- To process bookings, payments, confirmations, reschedules and cancellations.
- To send service emails and notifications, such as booking confirmations, reminders, account notices and support replies.
- To display Trainer profiles and reviews on the Platform.
- To provide customer support and respond to your requests.
- To maintain the safety and security of the Platform, prevent fraud and enforce our Terms of Service.
- To understand how the Platform is used and improve our services.
- To comply with legal obligations.
We will only send you marketing emails where permitted by law, and you can unsubscribe at any time using the link in the email.
3. How We Share Your Information
We do not sell your personal information. We share information only as described below:
- Between Clients and Trainers: when a Client books a session, we share the Client's name, email, phone number, booking details and notes with the Trainer so they can provide the session. Trainer profile information is publicly visible on the Platform.
- Service providers: companies that help us run the Platform, such as Stripe (payments), Google (sign-in and calendar services), email delivery providers and hosting providers. They may use your information only to provide services to us.
- Legal reasons: if required by law, court order or government request, or to protect the rights, property or safety of FITNEX, our users or others.
- Business transfers: if FITNEX is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction.
- With your consent: in any other case where you have asked us to share your information.
4. Google Calendar and Google User Data
Trainers can choose to connect their Google Calendar so that FITNEX bookings appear in it automatically. When a Trainer connects:
- We only use Google Calendar access to create, update and delete events for sessions booked through FITNEX, and to confirm that the connection is working.
- We do not read, copy or analyse the Trainer's personal calendar events.
- Access tokens are stored in encrypted form and are used only for the purposes above.
- We do not sell Google user data, use it for advertising, or share it with third parties except as needed to provide this feature or to comply with the law.
- The Trainer can disconnect at any time from the Google Sync page in their dashboard, or by removing FITNEX's access in their Google Account settings. When a Trainer disconnects, we delete the stored access tokens.
FITNEX's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
5. Data Retention
We keep your information for as long as your account is active or as needed to provide the Platform. We may keep certain information after your account is closed where necessary to comply with legal, tax or accounting obligations, resolve disputes, or enforce our agreements. When information is no longer needed, we delete or anonymise it.
6. Data Security
We use reasonable technical and organisational measures to protect your information, including encrypted connections (HTTPS), encrypted storage of sensitive tokens, and restricted access to personal data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep your password confidential and contact us immediately if you believe your account has been compromised.
7. Your Choices and Rights
- Access and update: you can view and update most of your information from your account or profile page.
- Delete your account: you can ask us to delete your account and personal information by contacting us.
- Email preferences: you can opt out of marketing emails at any time. Service emails related to your bookings and account will still be sent.
- Cookies: you can block or delete cookies through your browser settings.
Depending on where you live (for example, California and certain other U.S. states), you may have additional rights. These can include the right to know what personal information we collect, to request a copy of it, to have it corrected or deleted, and not to be discriminated against for exercising these rights. 8. Health and Fitness Information
The goals and notes you share (for example, weight loss, strength or injury details) help Trainers prepare for your sessions. Please share only what you are comfortable with. FITNEX is not a healthcare provider, and information you share on the Platform is not protected health information under HIPAA.
9. Children's Privacy
The Platform is not intended for children under 13, and we do not knowingly collect personal information from children under 13. Users between 13 and 18 may use the Platform only with the involvement and consent of a parent or legal guardian. If you believe a child has given us personal information, please contact us and we will delete it.
10. Third-Party Links
The Platform may contain links to third-party websites or services, such as Trainer social media profiles. We are not responsible for the privacy practices of those third parties, and we encourage you to read their privacy policies.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top of this page. If the changes are significant, we will notify you by email or through the Platform. Your continued use of the Platform after an update means you accept the revised policy.
